Article Summary:

The Legislative Committee of CCI-Toronto has provided important information about the Labour Relations Act and its impact on building services in Condominium Corporations. The information highlights Bill 148, known as the Fair Workplaces Better Jobs Act, 2017, which made changes to the Ontario Employment Standards Act, 2000, the Ontario Labour Relations Act, 1995, and the Occupational Health and Safety Act. Although many changes were later reversed by Bill 47, Section 69.1(1) of the Labour Relations Act continues to be relevant for building service providers in the condominium community. This section deems a sale of a business to have occurred, along with union rights, when one building service provider displaces another. This means that new service providers are bound by pre-existing collective agreements governing the terms and conditions of employment of the former provider.
