Legislative Newsflash: Legislation Prohibits Harassment Of Property Management

CCI Toronto and Area Chapter has received reports of property managers facing harassment in their respective condominium communities during the COVID-19 pandemic, particularly related to the enforcement of mask policies and other issues. Condominium corporations have a legal obligation to protect the health and safety of their on-site property managers as occupiers of the common elements, as mandated by the Occupier's Liability Act and Section 117 of the Condominium Act, 1998. Starting January 1, 2022, Section 117 will also explicitly prohibit acts likely to cause illness to an individual. Additionally, under the Occupational Health and Safety Act (OHSA), property managers are considered "workers," and condominium corporations have a legal obligation to investigate and prevent workplace harassment against them.
