Legislative Newsflash: Expanding the Condominium Authority Tribunal’s Jurisdiction to Include Nuisance-Related Disputes

The Ontario government will be proclaiming certain amendments to the Condominium Act, 1998, and its regulations into force on January 1st, 2022. These amendments expand the jurisdiction of the Condominium Authority Tribunal (CAT) to include disputes related to noise and other nuisances, such as odour, smoke, vapour, light, and vibration. As of January 1st, 2022, condominium corporations and unit owners or tenants will be able to bring applications to the CAT to resolve such disputes, eliminating the need for mediation and arbitration under the Condominium Act or applications to the Ontario Superior Court of Justice.
