Establishing Pet Restrictions

This article discusses the three sets of regulations that condominium corporations need to consider when establishing pet restrictions. The preferred way to establish pet restrictions is through amending the declaration, which requires the support of at least 80% of owners. Alternatively, the rules can be revised, which is easier but cannot be inconsistent with the declaration. The Residential Tenancies Act prevents the prohibition of pets in a residential lease, but it does not supersede the Condo Act. The Ontario Human Rights Code obligates condominium corporations to accommodate residents with disabilities recognized by the code to the point of undue hardship.
