The Construction Lien Amendment Act, 2017 will come into force on July 1, 2018, and will have an impact on any condominium project where there is a supply of services or materials to an “improvement”. The new act will modernize the construction lien and holdback rules, ensure workers and businesses get paid for the work performed, and help ensure payment disputes are addressed quickly and painlessly. There will be two waves of amendments, with the first taking place on July 1, 2018, and the second on October 1, 2019. The new legislation will introduce new construction lien and holdback rules, and new rules regarding prompt payment and a new interim adjudication regime.
